1. Acceptance of Terms

By downloading, installing, or using Toilet Panic ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

2. Service Description

Toilet Panic is a mobile application that helps users locate nearby public toilets using real-time location services and navigation. The app provides:

Real-time search for nearby public toilet facilities.
Map display with toilet locations and relevant details.
Navigation directions to selected facilities.
User reviews and ratings of facilities.
Premium features available through paid subscriptions.

3. Eligibility

Toilet Panic is available to users of all ages (rated 4+). No account creation is required to use the app's core features.

4. Subscriptions and Payments

4.1 Subscription Plans

Toilet Panic offers the following optional premium subscription plans:

4.2 Free Features

The core functionality of Toilet Panic — finding and navigating to nearby toilets — is available for free. Premium subscriptions unlock additional features such as offline access, advanced filters, and an ad-free experience.

4.3 Payment Processing

All payments are processed by Apple through the App Store. We do not collect or store your payment information. All purchases are subject to Apple's App Store terms and conditions.

4.4 Auto-Renewal Terms

Weekly, Monthly, and Annual subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
You can manage your subscriptions and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

4.5 Cancellation

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period. No partial refunds are provided for unused time within a billing period.

4.6 Refunds

Refund requests are handled by Apple in accordance with their refund policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support.

5. Acceptable Use

You agree not to:

Use the app for any unlawful purpose.
Attempt to reverse-engineer, decompile, or disassemble the app.
Interfere with or disrupt the app's services or servers.
Use automated systems or bots to access the app in a manner that exceeds reasonable use.
Attempt to circumvent rate limiting or abuse detection measures.
Submit false, misleading, or inappropriate reviews or ratings.
Use the app to harass, abuse, or harm others.

We reserve the right to restrict or terminate access to users who violate these terms.

6. Limitation of Liability

6.1 Toilet Availability

Toilet Panic does not guarantee the availability, accessibility, or condition of any toilet facility listed in the app. Facility information is sourced from third-party data providers and user contributions, and may be inaccurate, outdated, or incomplete. Facilities may be closed, relocated, or otherwise unavailable without notice.

6.2 No Warranty on Facility Quality

We make no warranties or representations regarding the quality, cleanliness, safety, or accessibility of any toilet facility. Users visit facilities at their own risk. Toilet Panic is an informational tool and does not operate, manage, or endorse any listed facility.

6.3 Navigation and Directions

Navigation directions provided by the app are for informational purposes only. We are not responsible for inaccurate directions, road closures, or any incidents that may occur while following navigation guidance. Always exercise caution and follow local traffic laws.

6.4 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOILET PANIC AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Intellectual Property

All content, features, and functionality of Toilet Panic — including but not limited to text, graphics, logos, icons, and software — are the property of the app's developers and are protected by copyright, trademark, and other intellectual property laws.

User-submitted content (reviews, ratings) remains the property of the submitting user, but by submitting content you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content within the app.

9. Third-Party Services

Toilet Panic integrates with third-party services including Google Maps Platform, Supabase, Sentry, and RevenueCat. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

10. Indemnification

You agree to indemnify and hold harmless the developers of Toilet Panic from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app or your violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and, where appropriate, through an in-app notification. Your continued use of the app after changes are posted constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your access to the app at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Toilet Panic regarding your use of the app.
